Terms of Service
These are the terms for using plantcrew, a mobile app provided by Planture Inc. (the "Company").
Chapter 1. General provisions
Article 1Purpose #
These Terms of Service ("Terms") govern the use of the mobile app plantcrew (the "Service") provided by Planture Inc. (the "Company"), and set out the rights, obligations and responsibilities of the Company and users, together with the conditions and procedures for using the Service.
Article 2Definitions #
- "Service" means everything the Company provides through the app, including plant registration and care records, care reminders, AI photo check (plant identification and leaf diagnosis), shared crew management, Crew Q&A and expert questions.
- "Paid Plan" means a subscription product offered by the Company, such as Solo, Crew or Crew Plus.
- "Crew" means a shared unit in which a Paid Plan subscriber invites other users to look after plants together. The person who creates and pays for the crew is the "Owner", and an invited user who joins is a "Member".
- "Shared Space" means the crew's plants, schedules and records that crew members view and record together.
- "App Marketplace" means a platform through which the app is distributed and payments are processed, such as the Apple App Store or Google Play.
- "Consumer" means an individual who uses the Service for purposes outside their trade, business, craft or profession.
Article 3Effect and amendment of these Terms #
- These Terms take effect when they are posted in the Service or on the Company website.
- The Company may amend these Terms to the extent permitted by applicable law.
- When the Company needs to tell users something, it uses whichever of an in-app notice, an in-app notification or an App Marketplace message is suitable, and may also post it on the website.
- When these Terms are amended, the Company will state the changes and the effective date and announce them by the means in Article 3.3 from 7 days before that date. Amendments that are unfavourable to users are announced from 30 days before.
- Where an amendment is unfavourable to users, the Company will obtain the user's express consent or let the user terminate the contract before it takes effect. If a user terminates on this basis, the Company asks the App Marketplace, under Article 12.3, to refund the amount for the unused part of the period and helps the user receive it.
Article 4Accounts and minimum age #
- Users create an account by signing in with Google or Apple and are responsible for keeping their account information accurate.
- An account may not be transferred, lent or sold to anyone else.
- The Service is only for people aged 14 or over. Where the law of the country where the user lives sets a higher age for using the Service or for consenting to the processing of personal information, the user must be at least that age.
- When signing up, users confirm that they meet the age requirement in Article 4.3.
- If an account is found to belong to someone below the age in Article 4.3, the Company will suspend it and delete the related data without undue delay.
Chapter 2. Paid services
Article 5Paid plans and display of prices #
- The Company offers the following Paid Plans.
| Item | Solo | Crew | Crew Plus |
|---|---|---|---|
| People (including the Owner) | 1 | 3 | 10 |
| AI photo check (identification and leaf diagnosis combined) | 30 a month | 50 a month | 300 a month |
| Expert questions | 3 a month | 5 a month | 10 a month |
| Care reminders | Included | Included | Included |
| Advertising | None | None | None |
| Monthly price | $3.99 | $6.99 | $12.99 |
| Yearly price | $19.99 | $34.99 | $69.99 |
- These prices are shown in US dollars (USD) for the English-language Service. The amount actually charged depends on App Marketplace regional pricing, exchange rates and taxes, and the amount shown at checkout prevails.
- In countries where tax-inclusive prices are required, the final amount including VAT and all other taxes is shown at checkout.
- The AI photo check count combines plant identification and leaf diagnosis. It refills every month on the same day as the day the subscription started (yearly plans refill monthly too), and unused counts do not carry over. AI photo checks and expert questions used by Members come out of the Owner's plan.
- The Company may change counts and prices. It will give notice under Article 3, and current subscribers keep the previous terms until the end of their current period. If a price goes up at renewal, the App Marketplace informs the user of the increase under its own process, and the user may cancel before the renewal.
Article 6Free trial #
- The Company offers first-time subscribers a 14-day free trial. The trial is provided as a benefit of the App Marketplace subscription product, and a payment method must be registered with the App Marketplace to start it.
- Before the trial starts, the following is shown on the app's subscription screen and at App Marketplace checkout, and the trial starts only after the user has seen it and agreed.
- that the trial turns into a paid subscription automatically
- the date it turns paid and the amount that will be charged
- the renewal cycle and the fact that it renews automatically
- how and by when the user can cancel
- The Company sends an in-app notification 3 days before the trial ends, with the date it turns paid and the amount. Users who have turned off notifications on their device may not receive it, and the date can also be checked in the App Marketplace subscription settings.
- If the user does not cancel before the trial ends, the price of the chosen plan is charged on the day the trial ends and the subscription begins.
- Each user can take the free trial once. The App Marketplace decides eligibility per account.
Article 7Payment and automatic renewal #
- Paid Plans are subscriptions that renew automatically. Unless the user cancels, the price of the next period is charged to the registered payment method when each period ends.
- Before any charge, the amount, the billing cycle, the fact of automatic renewal, and how and by when to cancel are shown clearly at checkout, and the charge goes ahead only with the user's express consent.
- Cancelling must be at least as simple as signing up. The Company will not add steps that delay or obstruct cancellation.
- Payments are processed by the App Marketplace's payment system, and its payment terms also apply. The App Marketplace collects the payment and bears the related responsibilities. The Company does not receive card numbers or other payment details.
- To stop automatic renewal, cancel at least 24 hours before the next renewal date. The exact deadline follows the App Marketplace's policy.
Article 8Changing plans #
- During a subscription, the user may move up one plan at a time (Solo to Crew, Crew to Crew Plus).
- On an upgrade, any adjustment for the rest of the current period follows the App Marketplace's subscription group policy, and the amount actually charged is shown before the user pays.
- A downgrade takes effect at the end of the current subscription period.
- If a downgrade leaves the crew over its size, the Owner picks who stays within 7 days. If nobody is picked by then, the Members who joined last leave the crew first. People who left can be invited again. The Company shows the overflow and the deadline in the app.
Chapter 3. Cancellation, withdrawal and refunds
The same refund rule (Article 12) applies to every user, and statutory withdrawal rights (Articles 10 and 11) are added depending on where the user lives. How to ask is also set out in the Refund Policy.
Article 9Cancellation #
- Users can cancel a subscription at any time, in the subscription settings of the App Marketplace they paid through. "More > Manage subscription" in the app goes straight there.
- App Store: Settings > your name > Subscriptions on your device, or apps.apple.com/account/subscriptions
- Google Play: Play Store app > profile > Payments & subscriptions > Subscriptions, or play.google.com/store/account/subscriptions
- When the user cancels in the App Marketplace, the result is passed on to the Company's server, and the App Marketplace confirms the cancellation to the user.
- After cancelling, the user can keep using the Service until the end of the period already paid for, and then automatic renewal stops.
- Deleting an account in the app does not cancel an App Marketplace subscription. To stop payments, cancel in the App Marketplace before deleting the account.
- When a subscription ends, the plants and records the user already has stay visible, and adding new records needs a subscription again.
Article 10Right of withdrawal — EEA and UK consumers #
- A consumer who lives in the European Economic Area (EEA) or the United Kingdom may withdraw from the contract within 14 days of concluding it, without giving any reason.
- The Company treats the Service as a digital service and does not ask users to waive the right of withdrawal in advance.
- On withdrawal, the Company refunds everything the user paid, through the procedure in Article 12.3, and charges nothing for use up to the point of withdrawal.
- A withdrawal can be made through the contact details in Article 23, "Send feedback" in the app, a refund request to the App Marketplace, or any other clear statement of the decision to withdraw, and the Company will acknowledge it without undue delay.
- The rights in this Article are separate from the refund rule in Article 12, and the Company does not limit or exclude them in any way.
Article 11Right of withdrawal — consumers in Korea #
- A consumer who lives in the Republic of Korea may withdraw within 7 days of receiving the written contract details or of the day the Service began, under the Act on the Consumer Protection in Electronic Commerce.
- The Company offers a free trial but does not use it as a reason to restrict withdrawal, and on withdrawal refunds everything the user paid, through the procedure in Article 12.3.
- The Company starts the refund process under Article 12.3 within 3 business days of receiving a withdrawal. For App Marketplace payments, it asks that marketplace to process the refund within the same period.
- Where the Service differs from its description or advertising, or is not delivered as contracted, the user may withdraw within the longer period the law allows.
Article 12Refund rule and procedure #
- Wherever they live, every user who asks within 14 days of the first paid charge of a subscription (if there was a free trial, the first charge after it ends) gets a full refund of what they paid, even if they have already used the Service.
- Article 12.1 is a rule the Company sets voluntarily. It adds to the statutory rights in Articles 10 and 11 and does not reduce them. Where the law of the country where the user lives gives a more favourable right of withdrawal or refund, that law prevails over these Terms.
- For App Marketplace payments, the marketplace collects the payment, so the refund itself follows its process, and for App Store payments Apple decides whether to refund. On receiving a refund request, the Company asks the marketplace for the refund without undue delay or tells the user how to ask the marketplace directly, helps the user get the refund, for example by providing the records needed, and keeps the user informed.
- The Company will not restrict a user's access only because they asked for a refund.
Chapter 4. Crews
Article 13Forming a crew and permissions #
- A Crew or Crew Plus subscriber becomes an Owner and can invite other users as Members, up to the plan's size.
- An invite code can be used by several people, within the crew's size, for 7 days from when it was issued.
- Members pay nothing. The Owner pays for the whole crew.
- Members use paid features under the Owner's plan, including for plants they registered outside the crew.
- AI photo checks and expert questions used by Members come out of the Owner's plan.
- The Owner can hand ownership to another Member from the crew screen. If the person who takes over does not subscribe within 7 days, the crew is paused.
Article 14Data within a crew #
- Plant details, care records, activity, questions and answers in the Shared Space can be viewed and added to by every crew member. Users should post on the understanding that other members will see it.
- The Owner can remove a Member, and a removed Member can no longer enter the Shared Space. If the Owner removes a Member or deletes the crew, a Member who joined the crew more than 14 days earlier can use paid features at the Solo plan level (excluding expert questions) for 7 days, with usage counted separately from the Owner's plan. The Company may withhold this where its criteria are met, such as when it would repeat for the same person or the same Owner.
- Even if a Member leaves the crew or deletes their account, the care records and notes they left in the crew may remain as records from a "former crew member".
- When the Owner's subscription ends, only the Owner remains in the crew and Members can no longer enter the Shared Space. Records Members left stay in the crew as in Article 14.3, and there is no feature for Members to export their own records.
- Retention and deletion of data are governed by the Privacy Policy.
Chapter 5. Expert questions
Article 15Conditions of provision #
- Expert questions are available on every Paid Plan within each plan's monthly count (Article 5), and only once during a free trial.
- One question means a question about one plant and its answer, plus one follow-up asked within 7 days of the answer and its reply.
- The count refills every month as in Article 5.4, and unused questions do not carry over.
- The Company answers within 72 hours of receiving a question. This applies to every plan. If the Company asks the user for more information, the clock stops until the user replies, and if the user does not reply within 7 days, the question is closed without the count being returned.
- To keep quality and speed, the Company may answer by having staff review and revise a draft written by an AI system. The provider used to prepare drafts is listed in section 5 of the Privacy Policy.
Article 16Nature and limits of answers #
- Answers to expert questions are general reference information on plant care and are not a diagnosis, a prescription or professional advice.
- Users should act on their own judgement and responsibility and, where needed, consult a qualified professional in the relevant field.
- The Company may decline to answer the following, and the count used is handled as set out below.
- questions that are not about plants: the count is returned the first time for each user, but not after that
- questions outside the scope of expert questions, such as medical, legal or sales matters: the count is returned
- repeated questions with the same or similar content: the count is returned
- inappropriate questions, such as abuse or spam, or questions that infringe third-party rights or break the law: the count is not returned
- If the Company does not answer within the response time (not counting time stopped under Article 15.4), the count for that question is returned.
Chapter 6. AI features, content and user obligations
Article 17Nature and limits of AI features #
- Users are informed that they interact with an artificial intelligence system when they use the AI photo check (plant identification and leaf diagnosis) and when expert answer drafts are prepared.
- AI results are estimates based on image analysis. The Company does not warrant that they are accurate, complete or fit for any particular purpose. Results vary with photo quality, angle, light and the plant's condition.
- Do not rely on AI identification results to decide whether a plant is edible, toxic or medicinal. The Company shows this warning on the AI photo check result screen.
- Care schedules and reminders are reference information that assumes typical growing conditions and may need adjusting for the actual environment.
- Questions and answers in Crew Q&A are opinions written by crew members, and the Company does not guarantee their accuracy. Inappropriate posts can be reported.
Article 18User content #
- Rights in the photos and records users upload ("User Content") remain with the user.
- Users grant the Company a non-exclusive licence to use, copy, store and process User Content to the extent needed to provide and run the Service. This licence ends when the contract ends and the data is deleted.
- The Company does not use User Content to train AI models. If it ever wants to, it will first ask for separate, express consent, independent of using the Service. Consent is optional, saying no does not limit use of the Service, and consent can be withdrawn at any time. Whether the providers of the AI photo check and expert answer drafts use the information they receive for training follows each provider's own policy (Privacy Policy, section 5).
- Users must not upload content that infringes the rights of third parties.
Article 19Prohibited conduct and restrictions #
Users must not:
- access the Service or call its functions by automated means, such as scripts, bots or crawlers;
- use the AI features to copy, extract or reverse-engineer the Company's databases or models;
- sell, lend or share an account or crew invitation rights;
- create several accounts to take free trials or promotions repeatedly;
- interfere with the normal running of the Service or put an excessive load on it; or
- post inappropriate content, such as abuse, harassment or spam aimed at other users.
- If a user breaches this Article, the Company may restrict use of the Service or terminate the contract after giving notice that states the breach and how the user can respond. Where urgent action is needed, the Company may act first and give notice without undue delay.
- To keep the Service stable, the Company may limit the request rate of an account where abnormally heavy use is found.
- Users may object to any measure the Company takes through the contact email in Article 23 or "Send feedback" in the app, and the Company will reply within 14 days of receiving the objection.
- Except where the contract is terminated because of the user's breach, if the Company terminates the contract, the Company asks the App Marketplace, under Article 12.3, to refund the amount for the unused part of the period and helps the user receive it.
Chapter 7. Miscellaneous
Article 20Changes to and suspension of the Service #
- The Company may change the Service or discontinue part of it. Changes that significantly affect a Paid Plan are announced under Article 3, and the user may terminate on that ground. In that case, the Company asks the App Marketplace, under Article 12.3, to refund the amount for the unused part of the period and helps the user receive it.
- If a core feature of a Paid Plan is discontinued so that the user can no longer achieve the purpose of the contract, the Company asks the App Marketplace, under Article 12.3, to refund the amount for the unused part of the period and helps the user receive it.
- The Service may pause for reasons beyond the Company's control, such as natural disasters, system failures or App Marketplace policy changes. The Company will promptly announce the pause and when it expects to restore the Service, by whichever means in Article 3.3 is available.
Article 21Liability #
- The Company is liable under applicable law for loss caused to a user by the Company's intent or negligence.
- For users acting in the course of a trade or business, the Company's liability is limited to the amount that user paid the Company in the previous 12 months. This paragraph does not apply to Consumers.
- Despite Article 21.2, no limitation of liability applies in the following cases:
- intent or gross negligence on the part of the Company;
- death or personal injury; or
- any other liability that applicable law does not allow to be limited.
- The Company is not responsible for the results of actions a user takes based on information from the Service, including AI results, except where the Company acted with intent or negligence.
Article 22Governing law, language and disputes #
- These Terms are governed by the laws of the Republic of Korea.
- Despite Article 22.1, Consumers keep the protection of the mandatory rules of the country where they habitually live, and nothing in these Terms excludes or limits that protection.
- A Consumer may bring proceedings in the courts of the country where they habitually live, and the Company will bring proceedings against that Consumer only in those courts. There is no exclusive jurisdiction clause.
- These Terms are published in Korean and English. If the two differ, the Korean version prevails to the extent that this is not unfavourable to the Consumer. Where the law of the Consumer's country requires the contract to be read in the language in which it was presented to them, that language prevails.
- Consumers who live in Korea may use the Korea Consumer Agency and related dispute resolution bodies. Consumers who live in the EEA or the UK may use the consumer protection authority or a consumer dispute resolution body in their country.
- If any provision of these Terms is held invalid, the remaining provisions stay in effect.
